1. Acceptance of Terms
By accessing or using Scholar's Alley ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and Scholar's Alley.
We reserve the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We will notify users of material changes via email or through the Service.
2. Description of Service
Scholar's Alley is an educational platform that provides AI-powered tutoring, quiz generation, educational games, content creation tools, and related services ("Educational Services"). Our Service is designed for K-12 students, parents, and educators.
- Tutor's Quill: AI-powered homework assistance with Socratic dialogue
- Knowledge Forge: Course generation, presentation creation, and document analysis
- Gaming Quarter: Educational games and challenges
- Guardian's Gate: Progress monitoring and family management tools
- Knowledge Vault: Personal knowledge bank for storing and organizing study materials
3. Account Registration and Security
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation.
You must be at least 13 years old to create an account, or have parental consent. For users under 13, accounts must be created and managed by a parent or legal guardian in compliance with COPPA requirements.
4. Credit System and Payments
Scholar's Alley operates on a credit-based system. Credits are the virtual currency used to access premium features and AI services.
4.1 Credit Purchase
Credits may be purchased through our payment processor (Stripe). By purchasing credits, you agree to Stripe's terms of service. All prices are in USD unless otherwise specified. We reserve the right to change pricing at any time with notice.
4.2 Credit Usage
Credits are consumed when using AI-powered features, generating content, or accessing premium services. Credit consumption rates are displayed within the Service. Credits are non-refundable, non-transferable, and have no cash value except as required by law.
4.3 Welcome Bonus
New accounts receive a one-time welcome bonus of 50 credits. Welcome bonuses are limited to one per person or household and cannot be transferred or exchanged for cash.
5. AI Services and Content
Our AI services are provided by third-party AI models (including OpenRouter and its partners). While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or incomplete information.
5.1 AI Usage Disclaimer
AI-generated responses are for educational assistance only and should not be relied upon as authoritative sources. You are responsible for verifying all information independently. We are not liable for any academic, professional, or personal outcomes resulting from reliance on AI-generated content.
5.2 Content Moderation
We implement content filtering to prevent harmful, illegal, or inappropriate content. However, no filtering system is perfect. You agree not to use the Service to generate or request content that is illegal, harmful, threatening, abusive, or violates any third-party rights.
5.3 Data Used for AI
Your content may be processed by third-party AI services to provide the Service. We do not use your personal data or uploaded content to train public AI models. Please refer to our Privacy Policy for detailed information about data handling.
6. User Conduct and Responsibilities
You agree to use the Service only for lawful, educational purposes and in accordance with these Terms. You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Violate any international, federal, provincial, or local laws or regulations
- Infringe upon or violate our intellectual property rights or the intellectual property rights of others
- Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- Submit false or misleading information
- Upload viruses or other malicious code
- Spam, phish, pharm, pretext, spider, crawl, or scrape
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service
We reserve the right to terminate your account if you violate these Terms or engage in any conduct that we deem harmful to the Service or its users.
7. Academic Integrity
Scholar's Alley is designed to be a learning tool that helps you understand concepts, not a service that does your work for you. You are solely responsible for ensuring that your use of the Service complies with your educational institution's academic integrity policies.
We encourage honest learning and discourage academic dishonesty. Submitting AI-generated work as your own without proper attribution may violate your school's honor code and could result in academic penalties.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Scholar's Alley and are protected by international copyright, trademark, and other intellectual property laws.
8.1 Your Content
You retain ownership of any content you submit, upload, or create through the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely to provide the Service.
8.2 AI-Generated Content
Content generated by AI services is provided to you for your personal, educational use. You may not claim copyright in AI-generated content or use it for commercial purposes without substantial human modification.
9. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.
For users under 13, we comply with the Children's Online Privacy Protection Act (COPPA). We collect minimal personal information from children and require parental consent for account creation and data collection.
10. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for any reason, including but not limited to violation of these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
You may terminate your account at any time by contacting us at scholarsalley@outlook.com. Upon termination, any remaining credits will be forfeited unless required by law.
11. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCHOLAR'S ALLEY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
IN NO EVENT SHALL SCHOLAR'S ALLEY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE PAST TWELVE (12) MONTHS.
13. Indemnification
You agree to defend, indemnify, and hold harmless Scholar's Alley and its affiliates, officers, directors, employees, agents, and third parties from and against any losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising out of or relating to your use of the Service or any violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by the courts of Victoria, Australia.
For Australian consumers, this agreement is subject to the Australian Consumer Law and the Competition and Consumer Act 2010 (Cth), which provides certain guarantees and rights that cannot be excluded, restricted or modified.
15. General Information
These Terms constitute the entire agreement between you and Scholar's Alley regarding the use of the Service. These Terms supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
